Waiguru fans want PAC report quashed by court

More than 0ne hundred Kirinyaga residents moved to court on Monday seeking to have National Assembly’s Public Accounts Committee (PAC) report implicating former Devolution Cabinet Secretary Anne Waiguru in the theft of funds at the National Youth Service (NYS) quashed.

The 1032 voters faulted the reporting, saying that it did not take into account relevant factors and that the National Assembly failed to involve the public before reaching its decision.

Further, they argued that the National Assembly recommendation that the ex-CS Waiguru be barred from vying for any elective office contravenes the provisions of Article 81(A) and (D) as they will not be in a position to exercise their political rights.

“In arriving at its decision, the National Assembly contravened provisions of Article 70 which establishes an Ethics and Anti-Corruption Commission which is mandated to deal with ethical matters,” reads the petition filed at the High Court.

The Kirinyanga County gubernatorial aspirant filed a similar case at the court challenging the National Assembly’s Public Accounts Committee recommendations.

PAC ordered Waiguru be held responsible for the theft of over Ksh791 million at the NYS and recommended that she be subjected, together with former top officials in the Devolution ministry, to a lifestyle audit for the last five years and the outcome made public by December 31.

The ex-Devolution CS, who has now been cleared by the Independent Electoral and Boundaries Commission to vie for the Kirinyaga Count governor seat, has sued the National Assembly, the Ethics and Anti-Corruption Commission, the Director of Criminal Investigations and the Attorney General and wants them blocked from further probing her.
