The high court has dismissed a case surrounding the validity of Nairobi Gubernatorial aspirant Johnson Sakaja.

In a ruling on Tuesday morning, the court said that IEBC had no error in clearing Sakaja to vie for the gubernatorial seat, dismissing the complaint on the basis of lack of proof.

There was no enough evidence to shift the evidential burden from the petitioner to Sakaja, with the court noting that it is the responsibility of the parties to prove allegations they bring before the court.

Denis Wahome had moved to court seeking to temporarily bar the Independent Electoral and Boundaries Commission (IEBC) from including Sakaja on the ballot. 

He wanted Sakaja's name omitted, arguing that his degree from Team University is not authentic.

Wahome had earlier filed the petition to challenge Sakaja's academic credentials before IEBC, but the tribunal dismissed it, saying it had no power to determine the validity of Sakaja's degree.
