Court reinstates ICT Authority CEO Stanley Kamanguya after board ouster

ICT Authority CEO Stanley Kamanguya resumed office on Friday after a
court order reinstated him, following his removal by the board on July 1.
Kamanguya, who returns with the matter still in court, urged leaders to
refrain from politicizing his reinstatement.
He emphasized the need for lawful processes and called for cooperation
from the board to keep advancing the country’s digital agenda.
"What we are hoping for is that, number one, all of us are subject
to the law, so we hope everybody is going to obey. Secondly, l am a committed
and diligent public servant, and l believe it is the same for the boar,” Kamanguya
said on resuming office.
“We should be able to work together for the better for not only this
organization, but for our citizens towards empowering them economically and
ensuring we do so in an inclusive manner.”
The ICT
Authority Board on July 1 revoked Kamanguya’s reappointment as CEO, citing
multiple procedural irregularities in the renewal process.
The decision,
made during a Board meeting held on the same day, came amid a pending High Court petition that had been filed by Kamanguya challenging efforts to remove
him from office.
In a letter to Kamanguya, the Board outlined
several reasons for nullifying the resolution passed on March 6, 2025, which
had recommended his reappointment for a new term starting August 8, 2025.
According to
the Board, Kamanguya's application for renewal, dated February 6, 2025, was
only received by the then Chairperson Sylvanus Maritim, on March 4, 2025—well
past the six-month deadline set by public service guidelines.
Additionally,
the Board claimed the March 6 meeting where the renewal was approved was
unlawfully reconvened without proper notice after it had already been
adjourned.
The
reappointment process, the Board argued, was also flawed because Kamanguya
himself prepared the board paper for his renewal instead of a special committee
conducting a performance evaluation as required under the Mwongozo Code and
relevant circulars.
The
resolutions confirming his reappointment, the Board added, were “hurriedly
extracted and illegally signed” by a sessional chairperson, further undermining
the integrity of the process.
“In light of
these patent irregularities, the Board has resolved to vacate the minutes of
the meeting held on March 6, 2025. Consequently, your reappointment as CEO of
the ICT Authority has been revoked,” the letter to Kamanguya then stated.

petition, Kamanguya argued that his reappointment was lawful and had already
been endorsed by the Cabinet Secretary for ICT and the Digital Economy.
He claimed the
Board's attempts to reverse the process amounted to interference and breach of
due process.
