EACC seeks to recover Ksh.200M public land in Eldoret CBD

The Ethics and Anti-Corruption Commission (EACC) has filed a suit seeking to recover prime public land in Eldoret’s Central Business District, estimated to be worth Ksh.200 million. 

According to EACC, the parcels of land, Eldoret Municipality Block 7/210 and Block 7/248, cover a total of 3.44 acres and were originally set aside for government housing projects. 

The land, the Commission states, was illegally reserved for former Permanent Secretary for Provincial Administration and National Security Wilfred Kitur Kimalat, and Endo Holdings Limited, a company linked to the late Ishmael Chelang’a, who served in senior public roles, including the Provincial Commissioner for Rift Valley Province.

Also named in the suit is Wilson Gacanja, who is accused of breaching the law by facilitating the illegal transfer of the public land. 

EACC noted that the two parcels of land, where government houses stand, had been reserved for public use and were under the management of the State Department for Housing and Urban Development. 

However, the Commission's investigations revealed that the properties were never available for private allocation. 

In the case filed at the Environment and Land Court in Eldoret, the Commission is seeking a declaration that the lease and subsequent transfer of land are null and void.

Further, EACC seeks the cancellation of all land registrations tied to the alleged fraud and a permanent injunction barring any further transactions involving the disputed property. 

Justice E.M. Washe has certified the injunction application as urgent and scheduled the hearing for July 23, 2025.
