Homa Bay Governor will not have to pay Ksh.20M – Court

An application seeking to compel Homa Bay Governor Cyprian Awiti to deposit Ksh.20million as security has been dismissed.
The Court of Appeal in Kisumu set aside the application for payment of security of costs before judgement of an appeal by the governor is determined.
According to Justice Phillip Waki, the application lacked merit.
It had been filed by Oyugi Magwanga who lost during the gubernatorial elections in 2017.
In February, the High Court in Homa Bay nullified the election of Mr. Awiti over electoral irregularities.
The court then ordered the Independent Electoral and Boundaries Commission (IEBC) to conduct a repeat election that meets the threshold set in the Constitution and election laws.
However, Mr Awiti accused the judge of making grave errors in law and fact.
A month later, the Governor through Prof Tom Ojienda and Associates Advocates, sought to overturn Judge Joseph Karanja’s judgment that nullified his victory.
